1. General
1.1 These Terms & Conditions apply to the entire content of the website under the domain name www.vivisence.com ("website") and to any correspondence by email and any contracts between us and you. Please read these Terms & Conditions carefully before using this website. By accessing, browsing, using or registering on our website, you agree to all of the Terms & Conditions in their entirety. The Terms and Conditions applicable to your purchase are those published on our website at the time you place your order. We recommend reviewing this page regularly to stay informed about any updates. We reserve the right to amend these Terms and Conditions at any time. In the event of significant changes, we will notify users in advance by email and post a notice on this page. Such changes will take effect on the date specified in the notice.
1.2 This website is operated by Kontri Limited a company registered in England and Wales (company registration number 08505698) whose registered office is at 49 Hevea Road Burton-on-Trent DE13 0SH. Our registered VAT number is 163766385. Unless we say otherwise, we use the terms "Kontri", "we" and "us" on this website to refer to Kontri Ltd throughout the website Terms & Conditions.
1.3 In accordance with our Terms and Conditions, a consumer is defined as an individual who acts for purposes that are entirely or predominantly unrelated to their trade, business, craft, or profession.
2. Privacy policy
We are responsible for all personal data that you provide us with. We therefore have a Privacy Policy outlining how your personal data will be processed and protected by Kontri Ltd. You will find our Privacy & Cookie Policy in full here. This policy applies whether you visit our online store, shop with us or otherwise engage with us.
3. Intellectual property
3.1 You acknowledge and agree that all rights, including copyright, trademarks and other intellectual property rights in all materials and/or content made available as part of your use of this website shall remain at all times vested in us or our licensors. You are permitted to use this material only as expressly authorised by us or our licensors.
3.2 You acknowledge and agree that the material and content contained within this website is made available for your personal non-commercial use only and that you may only download such material and content for the purpose of using this website. You also acknowledge that any other use of the material and content of this website is strictly prohibited and you agree not to (and agree not to facilitate or assist any third party to) copy, reproduce, transmit, publish, display, distribute, commercially exploit or create derivative works of such material and content.
4. Ordering and Paying
4.1 Kontri Ltd has taken reasonable precautions to try to ensure that prices quoted on the website are correct and that all products have been fairly described. The presentation of goods in the online shop does not represent a binding offer of Kontri Ltd, but a request to you to submit such a binding offer.
4.2 All card payments are subject to authorisation by your card issuer.
4.3 The total amount to pay for your order will be the item price plus delivery charges (if any). The delivery charge will be shown during the checkout process. Please note all orders are shipped from Poland. For deliveries to Great Britain we cover import related charges.
4.4 If we do not receive payment within 14 days from the date you placed your order, that order will be cancelled.
4.5 To place an order, you need to open a Customer Account with us which will require you to provide some compulsory personal information.
4.6 By placing an order for products through vivisence.com you confirm that you intend to enter into a contract with us for the purchase of selected products. You complete your order by clicking the “ORDER AND PAY” button at the end of the checkout process. Once your order is submitted, you will receive an email containing your order number and details of the purchased items. Please note that this email serves only as an acknowledgment of your order and does not constitute our acceptance. The contract of sale between you and us is formed only when we send you a confirmation email stating that your order has been dispatched or when you receive your order, whichever comes first. The contract remains in effect until the final day of your right to cancel.
4.7 The language applicable to your contract with Kontri Ltd depends on the language version of the website you selected when placing your order. You may browse our store in different languages; however, the version of these Terms and Conditions corresponding to the language used at the time of your order shall govern your contract. We will provide you with the text of the contract in writing by including it in the email confirming receipt of your order.
4.8 If you made an error in your order, please contact our Customer Support as soon as possible. However, we cannot guarantee that we will be able to amend your order in accordance with your instructions.
4.9 If we are unable to fulfill your entire order for legitimate reasons (for example, product unavailability), we reserve the right to cancel it. In such cases, we will inform you immediately and refund any payment already made. The refund will be made via the same payment method originally used, unless otherwise agreed. If we are unable to fulfill only part of your order, the above rules will apply only to the affected items. You are also entitled to withdraw from the remaining part of your order, if you wish.
4.10 If your order hasn’t arrived, please contact us within 14 days of the expected delivery date.
4.11 Only persons over eighteen years of age can place an order.
4.12 We reserve the right to impose a monetary limit on any single order or to set quantity limits on individual products available on our online store, at our sole discretion.
5. Accuracy of content
Kontri Ltd attempts to be as accurate as possible. We make every effort to ensure that the product colour is as accurate as possible, but the colours shown may vary depending on your device’s display settings. Please note that the dispatch and delivery times are only estimates and cannot be guaranteed. We reserve the right to correct any errors, inaccuracies or omissions on our website and to change or update information at any time without prior notice.
6. Prices and availability
6.1 Prices and availability of items on our website may change at any time without prior notice. However, the price you pay will be the price displayed at the time you place your order. All prices are displayed in pounds sterling or euro (depending on your choice) and UK/EU orders are inclusive of any VAT (where applicable) at the current rate for which we are responsible as a seller (VAT charged will be either VAT of the country of delivery or country of dispatch). Although VAT is not charged for goods delivered outside the UK or EU, our website shows a uniform price for each item regardless of destination. This means that the price displayed includes any applicable margins and does not vary depending on the VAT status of the delivery destination. Customers outside the UK/EU may still be required to pay import duties or taxes upon receipt, according to local regulations.
6.2 The total amount to pay for your order will be the item price plus any delivery charges (if any, specified separately), but will not include import duties and other import charges (please see section Customs & Duties of these Terms & Conditions for more details). Please note all orders are shipped from Poland. For deliveries to Great Britain, we cover import-related charges.
6.3 International credit card providers or banks determine the exchange rate and may charge additional processing or administrative fees, which are the responsibility of the cardholder.
6.4 This website contains a large number of goods and it is possible that, despite our best efforts, some of the goods listed may be incorrectly priced. If we discover an error in the price of the goods you have ordered we will inform you as soon as possible. In this case we reserve the right to cancel the order and fully refund any amounts received.
7. Delivery
7.1 Delivery will be to the UK or international address as specified in your order (subject to the provision of paragraph 7.3).
7.2 We aim to dispatch orders as soon as possible after we receive your cleared payment. In case of bank holidays, over the Christmas time or other high volume periods (for example Valentine's Day), please allow a few extra working days for dispatch and delivery. Delivery times shown on the website are an estimate only. The cost of delivery will be displayed at the checkout prior to submitting your order.
7.3 Delivery, both domestic and international, may be subject to restrictions. For current information on delivery restrictions please visit the Delivery section of the Help pages to this website.
7.4 If delivery of the goods fails for reasons attributable to the customer (e.g., incorrect delivery address, repeated absence at the time of delivery, or failure to collect the package within the time limit set by the carrier), the customer shall bear any additional reasonable costs incurred by the seller as a result of this failure, including the cost of returning the goods and, where applicable, the cost of a new shipment.This shall not apply where the customer has validly exercised the right of withdrawal. In such cases, the return costs are governed by the provisions relating to the right of withdrawal.
7.5. Kontri Ltd retains full ownership of the products until both of the following conditions are met:
- full payment of the purchase price has been received; and
- the products have been delivered to you or to a person identified by you to take possession of them.
7.6 All risk in the products (including the risk of loss or damage) shall pass to you when you, or a person identified by you to take possession of the products, take physical possession of them
7.7 Please check the delivered goods immediately upon receipt. Any visible transport damage or incorrect deliveries should be noted with the delivery person at once and reported to us without delay. If you believe a product was delivered faulty, damaged or incorrectly supplied, you should inform us as soon as possible, preferably in writing using our contact details.
7.8 We do not offer self-collection of orders for logistical reasons.
8. Customs & Duties
8.1 Please note all orders are shipped from Poland. For deliveries within the European Union, no additional customs duties are payable by the customer upon receipt. For deliveries to Great Britain, we cover import-related charges.
8.2 If the international delivery is outside GB/EU the recipient is responsible for paying import duty or other import related charges (for example tax) prior to or on delivery (if such charges are applied). You are responsible for checking with local authorities the relevant import regulations, including order value threshold, duties or documents required for import procedure.
9. Your Right to Cancel
9.1 Consumers from the UK and the EU have the right to withdraw from this contract within thirty (30) days without giving any reason.
9.2 The withdrawal period will expire thirty (30) days from the day on which you, or a third party other than the carrier and indicated by you, acquire physical possession of the goods, or — in the case of partial deliveries — the last item delivered.
9.3 To exercise your right of withdrawal, you must inform us — Kontri Ltd, 49 Hevea Road, Burton-on-Trent DE13 0SH, United Kingdom, email: contact@vivisence.com — of your decision to withdraw from this contract by means of a clear statement (for example, a letter sent by post or an email).
You may use the model cancellation form below, but it is not obligatory.
9.4 To meet the withdrawal deadline, it is sufficient for you to send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.
Effects of Withdrawal
9.5 If you withdraw from this contract, we shall reimburse to you all payments received from you, including the cost of delivery (except for any supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen (14) days from the day on which we are informed of your decision to withdraw from this contract. If you return only part of your order, the delivery cost will not be refunded.
9.6 We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
9.7 We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
9.8 You must send back or hand over the goods to us without undue delay, and in any event no later than fourteen (14) days from the day on which you communicate your withdrawal from this contract to us.
The deadline is met if you send back the goods before the period of fourteen (14) days has expired.
9.9 We will bear the direct cost of returning the goods only if you follow the return instructions provided by email (for example, by using the prepaid return label supplied). If you choose a different return method, you will bear the direct cost of returning the goods. The company's registered office address should not be used for the return of purchased products. Returns should only be made in accordance with the return instructions provided by our customer service department. For UK customers, the returns address is in the UK. For EU customers, the returns address is in Poland.
9.10 You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
9.11 If you have contacted us to cancel your contract before your products arrive, though your order will have been cancelled, we may be unable to cancel the delivery. In that case, please refuse any delivery of cancelled products or return them to us.
9.12. To exercise the right to cancel, the return must be initiated and registered under the name of the person who placed the order and is the holder of the payment account used for the purchase. Refunds will be issued exclusively to that individual and to the same payment method used for the original transaction.

Practical return advice (optional, without prejudice to your statutory withdrawal rights):
- When trying on clothing, please avoid leaving traces of make-up, perfume or deodorant.
- Tights and similar items should only be tried on over your own underwear.
- Pack items carefully to prevent damage during transport.
- If you return items at your own expense using a carrier of your choice, we strongly recommend using a tracked delivery service.
- The company's registered office address should not be used for the return of purchased products. Returns should only be made in accordance with the return instructions provided by our customer service department. For UK customers, the returns address is in the UK. For EU customers, the returns address is in Poland.
9.13 Your statutory rights remain unaffected.
10. Complaints and Mediation

We always strive to handle complaints promptly and fairly.
10.2 If you remain dissatisfied, you may be able to seek further assistance through alternative dispute resolution (ADR) or a relevant independent body, depending on the nature of your complaint. In accordance with the Alternative Dispute Resolution for Consumer Disputes (Competent Authorities and Information) Regulations 2015, we inform you that RetailADR (https://www.retailadr.org.uk) is an approved ADR entity competent to deal with consumer complaints.
However, we are neither obliged nor willing to participate in any ADR procedure before this or any other ADR body.
11. Sales to entrepreneurs
To the extent permitted by applicable law, the warranty for physical and legal defects shall be excluded if the buyer is an entrepreneur, or if, in light of the circumstances, it can reasonably be assumed that the goods were purchased for purposes directly related to the buyer’s trade, business, or profession.
12. Electronic Services
We may offer the following services to our users (Service Recipients) electronically and free of charge:
- Subscription to our Newsletter,
- Customer Account Maintenance,
- Posting and publishing Product Review.
12.1 Newsletter
When you subscribe to our Newsletter service, we will send promotional emails to the address you provided. To sign up, complete the subscription form available on vivisence.com. You can unsubscribe from our Newsletter at any time by clicking the "Unsubscribe" link included in each email or via the vivisence.com website. You may also send us an email regarding this. Please note that processing such requests may take some time, so you may still receive messages during this period. Additionally, we’d like to inform that we use measurement tools that check, among others: newsletter opening rate and click rate. By signing up for our Newsletter, you consent to the use of these tracking methods.
12.2 Customer Account
12.2.1 This service allows you to create and manage your personal account on our store's website. It enables you to:
- place orders using your saved account details,
- track your order status and history,
- update your account information,
- create shopping/wish lists.
12.2.2 By registering, you warrant that the personal data requested is true, correct, current and complete in every respect. If you discover that your details are incorrect or no longer up to date, you undertake to correct them immediately.
12.2.3 You are responsible for all actions carried out under your account or using your password, unless these result from a security breach or an attack by a third party through no fault of your own. You must keep your password confidential and protect it against unauthorized access. We shall not be liable for any damages arising from gross negligence or intentional breach of this obligation on your part. We commit to taking appropriate technical and organizational measures to protect your data in accordance with the UK/EU GDPR.
12.2.4 Requests to delete Customer Accounts should be directed to privacy@kontri.co.uk. Deletion requests will be processed only if we have no outstanding legal obligations related to that account. We reserve the right to delete any Customer Account, along with any associated data and activity, if it remains inactive for a period of 6 years. Prior to deletion, you will be notified of our intent to delete your inactive account. The 6-year period is calculated from the end of the last financial year in which the account's last activity occurred.
12.3 Product Reviews
12.3.1 This service allows users to publish personal and subjective reviews about products on the store's website. You need a Customer Account to submit reviews. Reviews will be marked accordingly to indicate whether they are verified by purchase or not. Our website may also display reviews published on other online sales channels, e.g. Amazon marketplaces.
12.3.2 Kontri, as a website operator, verifies all reviews and reserves the right to reject those that violate law or accepted social norms. You may not post content that:
- is unrelated to our products or services,
- contains links, unauthorized advertising, or promotions,
- incites illegal activities, fraud, or violence,
- promotes totalitarian systems or incites hatred based on gender, nationality, ethnicity, religion, or other differences,
- is defamatory, vulgar, offensive, or discriminatory,
- violates others’ rights or encourages dangerous behavior.
12.3.3 If you submit content or materials to us, unless explicitly stated otherwise, you provide Kontri Ltd with a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable license to utilize, reproduce, modify, adapt, publish, perform, translate, create derivative works from, distribute, and display the submitted content globally and across all media. Additionally, you grant Kontri Ltd and its sublicensees the right to use the name associated with your submission in connection with the content, at their discretion.
12.3.4 We are committed to ensuring that all product reviews published on our website reflect the genuine experiences of verified customers. On our website vivisence.com we do not publish paid, incentivised or otherwise manipulated reviews. This includes reviews provided in exchange for money, discounts, gifts, or free products. Our review process is designed to ensure compliance with the Digital Markets, Competition and Consumers Act 2024 and to maintain transparency and trust in our product feedback.
12.4 Electronic Services- Access and Usage
12.4.1 You must use our website lawfully, respecting intellectual property and personal rights of others.
12.4.2 To access most of our Electronic Services, you need an internet-connected device with a modern web browser that supports proper website functionality. We are not responsible for service interruptions caused by system failures or external factors beyond our control.
12.4.3 We reserve the right to:
- suspend services temporarily for IT system maintenance or to address security concerns;
- suspend, limit, or discontinue the provision of any electronic services, in whole or in part, at any time, for technical, organizational, legal, or security reasons.
Where reasonably possible, we will provide users with prior notice of any significant changes or discontinuation of such services.
Services may also be discontinued if required by an internet provider or other authorized entities, or if users breach the Terms & Conditions, applicable law or generally accepted social and moral norms.
12.5 Electronic services- Complaints Procedure
12.5.1 Complaints regarding both technical issues and other aspects of our Electronic Services can be submitted via email to contact@vivisence.com or in writing to the address of Kontri Ltd. Complaints should include: a brief description of the issue, the date and time it occurred, and the user’s name, surname, and email address. Complaints are typically reviewed within 14 days, with the result communicated via email.
12.5.2 You may appeal decisions within 14 days, providing a detailed justification. Appeals are reviewed within 14 days.
12.5.3 Complaints concerning user posted content will result in a decision to either retain or remove the content, based on Kontri Ltd’s assessment.
13. Law and Jurisdiction
13.1 Consumers
If the customer is a consumer, all legal relationships between the contracting parties shall be governed by the law of the country in which the customer has their habitual residence, subject to any mandatory consumer protection provisions applicable there.Disputes may be brought before the courts competent under applicable law, in particular those of the customer’s habitual residence or of the seller’s registered office.This clause does not affect any statutory rights you may have to bring proceedings in your country of residence.
13.2 Business customers
If the customer is a businessperson, all legal relationships between the contracting parties shall be governed by the law of the country in which the seller has its registered office, excluding the UN Convention on Contracts for the International Sale of Goods.The exclusive place of jurisdiction for all disputes arising from this contract shall be the seller’s registered office
14. Severability
If any of these Terms & Conditions are found to be illegal, invalid or unenforceable by any court of competent jurisdiction, the rest of these Terms & Conditions shall remain in full force and effect.
15. Legal Guarantee (Statutory Warranty)
15.1 We provide our products in accordance with the applicable statutory provisions on consumer rights and product conformity, unless otherwise expressly stated below.
15.2 To the maximum extent permitted by law, statutory warranty rights for defects in goods or title are excluded in business-to-business transactions, unless we have acted wilfully, with gross negligence, or have fraudulently concealed a defect. This exclusion does not affect any mandatory rights under the Consumer Rights Act 2015, the Product Liability Act 1987, or liability for death, personal injury, or damage to health caused by our negligence.No extension of statutory limitation periods shall apply.
Statutory limitation periods for recourse claims remain unaffected.
15.3 In consumer transactions, customers are entitled to the statutory rights for defective goods as provided under the Consumer Rights Act 2015
16. Liability
16.1 We shall be liable without limitation for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and for any other liability that cannot be excluded under applicable law (including mandatory product liability).
16.2 For consumers, we shall also be liable for losses resulting from our breach of contract, but in cases of slight negligence our liability shall be limited to typical and foreseeable losses.
16.3 In business-to-business transactions, to the fullest extent permitted by law, we exclude liability for indirect or consequential losses, including loss of profit.
16.4 The above limitations shall likewise apply to our legal representatives, employees and agents.
17. Miscellaneous Provisions
17.1 Only you and we shall be entitled to enforce these Terms & Conditions. No third party shall be entitled to enforce any of these Terms & Conditions, whether by virtue of the Contracts (Rights of Third Parties) Act 1999 or otherwise.
17.2 We will not be responsible to you for any delay or failure to comply with our obligations under these Terms & Conditions if the delay or failure arises from any cause beyond our reasonable control.
17.3 If you breach these Terms & Conditions and we take no action, we will still be entitled to use our rights and remedies in other situations where you are in breach.
17.4 We make reasonable efforts to ensure that our website is free from viruses and other malicious or harmful content. However, we cannot guarantee that your use of this website (including any content on it or any website accessible from it) will not cause damage to your computer or other device. It is your responsibility to ensure that you have the right equipment (including anti-virus software) to use this website safely. Except where required by applicable law, Kontri shall not be liable to any person for any loss or damage they suffer as a result of viruses or other malicious or harmful content that they access from or via our website.
17.5 We will use all reasonable endeavours to ensure that the website remains available at all times. However, we cannot guarantee that the website will operate continuously. We therefore cannot accept any liability for any failure or non-availability of the website.
